OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a fall hazard: Rear of the building, along College St: On or about December 19, 2016, employees were exposed to a fall hazard while using a job-made wooden platform to elevate personnel. The platform was supported by a JLG SkyTrak Telehandler, Model 6042, while the employees attempted to gain access to a third floor storage room through an exterior window.

29 CFR 1910.178(l)(1)(i): The employer did not ensure that each powered industrial truck operator is competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l) AND AS REFERENCED BY THE NOTE CONTAINED IN 1926.602(d): 29 CFR 1926.602(d): The employer did not certify that each operator had been trained and evaluated as required by paragraph 29 CFR 1910.178(l): Note: The requirements applicable to construction work under paragraph (d) of this section are identical to those set forth at paragraph (l) of 29 CFR 1910.178. Rear of the building, along College St: On or about December 19, 2016, employees were exposed to fall and ejection/crushing hazards, while the forklift operator was not trained and evaluated on the safe operation of a JLG SkyTrak Telehandler, Model 6042.
