29 CFR 1926.451(a)(6): Scaffolds were not designed by a qualified person: (a) On or about December 20, 2016, Rebey Construction, as the controlling employer, did not ensure that employees of Pedro Vasquez, roofing subcontractor, were protected from falls approximately 18.0 feet while riding in a wooden basket supported by a Genie GTH 1056 forklift, which was built for the purpose of removing roofing material, not hoisting personnel. (b) On or about December 22, 2016, Rebey Construction, as the controlling employer, did not ensure that employees of Pedro Vasquez, roofing subcontractor, were protected from falls approximately 18.0 feet while riding in a wooden basket supported by a Genie GTH 1056 forklift, which was built for the purpose of removing roofing material, not hoisting personnel. Abatement Note: Abatement certification is required for this item (see enclosed "Certification of Corrective Action Worksheet").

(b) On or about December 22, 2016, Rebey Construction, as the controlling employer, did not ensure that employees of Pedro Vasquez, roofing subcontractor were protected from falls approximately 18.0 feet while riding in a wooden basket being supported by a Genie GTH 1056, without top rails and mid rails installed in front of the basket.
