29 CFR 1910.23(c)(1): Open-sided floors and/or platforms four feet or more above adjacent floor or ground level were not guarded with standard railings (or equivalent) and toeboards: Note: Toeboards are only required when persons can pass, there is moving equipment or there is equipment with which falling materials could create a hazard. Blend Area - On or about 12/21/16 and at times prior thereto the platform for the pre-breaker (hammer mill) was not guarded, exposing operators to falls from a 4.0 ft. 9.0 in. elevation onto the concrete floor. In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification. This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.

29 CFR 1910.24(h): Standard railings were not provided on the open sides of all exposed stairways and stair platforms: a) Blend Area - On or about 12/21/16 and at times prior thereto the stair leading to the pre-breaker (hammer mill) platform did not have a middle rail installed, exposing operators to falls from a 5.0 ft. 9.0 in. maximum elevation onto the concrete floor. In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification.
