29 CFR 1926.451(a)(6): Scaffolds were not designed by a qualified person:  On or about December 28 2016, and at times prior thereto, a job made mud box was supported by a rough terrain forklift and was used to elevate personnel for stucco work. The employer who designed the platform was not qualified and/or did not adhere to published guidelines for safe use and design of elevating platforms and rough terrain forklifts, such as ASME/ANSI B56.6, 2005 and specifically, section 8.24, items such as:  a)  A platform floor having slip resistant surface. b)  A 4 inch minimum height toe plate which may be omitted at the access opening. c) Protection for personnel in their normal working position on the platform from moving parts of the rough terrain forklift truck that present a hazard. d) A means to securely attach the platform to the lifting mechanism, and to prevent the platform from inadvertent pivoting.  Employees were exposed to pivoting, slippage or tipping of the platforms and forklift creating a fall hazard of approximately 20 feet.

29 CFR 1926.451(f)(3): Scaffolds and scaffold components were not inspected for visible defects by a competent person before each work shift, and after any occurrence which could affect a scaffold's structural integrity:  On or about December 28 2016, and at times prior thereto, the employer did not have a competent person perform daily inspections of the scaffold platform (job made mud box ), exposing employees to the hazards of falls and/or scaffold collapse/failure.

29 CFR 1926.602(c)(1)(ii): Modifications or additions which affect the capacity or safe operation of the equipment were made without the manufacturer's written approval:  On or about December 28, 2016 and at times prior thereto, a wooden platform (job made mud box) supported by a Sky Trak rough terrain forklift was used to elevate personnel for construction work. The employer did not consult the manufacturer on the design of the platforms and necessary changes to the forklift operational decals. Employees were exposed to the hazards of falls up to approximately 20 feet and/or scaffold collapse/failure.

29 CFR 1926.451(c)(2)(iv): Front-end loaders and similar pieces of equipment were used to support scaffold platforms when they were not specifically designed by the manufacturer for such use:  On or about December 28, 2016, and at times prior thereto, a wooden scaffold platform (mud box) which was installed on a SkyTrak rough terrain forklift was used to elevate personnel to perform work on the apartment complex under construction. The forklift was not designed for such use per the manufacturer's operations manuals, exposing employees to the hazards of falls of approximately 20 feet.

29 CFR 1926.451(c)(2)(v): Fork-lifts were used to support scaffold platforms while the entire platform was not attached to the fork and the fork-lift was moved horizontally while the platform was occupied:   On or about December 28 2016, an employee worked from an elevated job made mud box that was not securely attached to the lift to prevent the platform from sliding off. The platform was used on a Sky Trak rough terrain forklift to lift and lower the employee to deliver the stucco mud to employees on a scaffolding system next to the apartment complex under construction, exposing the employee to a fall hazard of approximately 20 feet.
