OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fall hazards when de-cabling railcars: On or about December 29, 2016, the employer did not protect employees from fall hazards associated with walking on top of railcars without the use of fall protection when de-cabling loads of lumber exposing employees to an approximately 15 feet fall to the ground below.

Items such as bags, containers, bundles, etc., were not stored in tiers and stacked, blocked, interlocked and limited in height so that they were stable and secure against sliding or collapse: On or about December 29, 2016, the employer did not ensure material was stacked so that it was stable and secure against sliding and collapsing in the following locations. Location 1: Building #3, ZIP System roof and wall sheathing was stacked in manner in which it was leaning. Location 2: Office Warehouse, plywood was stacked in a manner in which in was leaning.
