29 CFR 1910.147(c)(4)(ii): Procedures did not clearly and specifically outline the scope, purpose, authorization, rules, and techniques to be utilized for the control of hazardous energy, and the means to enforce compliance including, but not limited to, 29 CFR 1910.147(c)(4)(ii)(A), (c)(4)(ii)(B), (c)(4)(ii)(C) and (c)(4)(ii)(D):    a) 400 Centerpoint Blvd., New Castle DE - On or about January 12, 2017, the employer failed to ensure that the developed energy control procedure clearly identified specific steps to be followed to control hazardous energy for equipment on which employees perform service and maintenance, to include the baler and compactor.    NOTE: The procedures must be documented in sufficient detail and provide enough direction so that employees can effectively follow the procedure and determine how to safely perform the servicing and maintenance activities. Over generalization can result in a document which has little or no utility to the employee who must follow procedure. However, while the procedure is required to be written in detail, this does not mean that a separate procedure must be written for each and every machine or piece of equipment. Similar machines and/or equipment (those using the same type and magnitude energy) that has the same or similar types of controls can be covered with a single procedure.

29 CFR 1910.147(d)(2): The machine or equipment was not turned off or shut down using the procedures established for the machine or equipment:     a) 400 Centerpoint Blvd., New Castle DE - On or about January 12, 2017,  the employer failed to ensure an orderly and safe shut down of equipment prior to servicing or maintenance (cleaning) of the baler.  As a result, the remaining applicable energy control elements, involving machine isolation [(d)(3)], LOTO device application [(d)(4)], stored energy [(d)(5)], and verification of isolation [(d)(6)], were not implemented to safeguard employees from the machine servicing hazards.

29 CFR 1910.147(c)(6)(i): The employer did not conduct a periodic inspection of the energy control procedure at least annually to ensure that the procedure and the requirement of this standard were being followed:     a) 400 Centerpoint Blvd., New Castle DE - On or about January 12, 2017, the employer failed to ensure an inspection of the developed written energy control procedure was conducted at least annually.     Abatement Note:      1.  Where lockout is used for energy control, the periodic inspection shall include a review, between the inspector and each authorized employee, of that employee's responsibilities under the energy control procedure being inspected.1910.147(c)(6)(i)(D)     2.  Where tagout is used for energy control, the periodic inspection shall include a review, between the inspector and each authorized and affected employee, of that employee's responsibilities under the energy control procedure being inspected, and the elements set forth in paragraph (c)(7)(ii) of this section.1910.147(c)(6)(ii)     3.  The employer shall certify that the periodic inspections have been performed. The certification shall identify the machine or equipment on which the energy control procedure was being utilized, the date of the inspection, the employees included in the inspection, and the person performing the inspection.
