29 CFR 1926.200(g)(2): All traffic control signs or devices used for protection of construction workers shall conform to Part VI of the Manual of Uniform Traffic Control Devices ("AMUTCD"), 1988 Edition, Revision 3, September 3, 1993, FHWA-SA-94-027 or Part VI of the Manual on Uniform Traffic Control Devices, Millennium Edition, December 2000, FHWA, which are incorporated by reference. a. On or about January 11, 2017, at the above referenced work site, employees were preparing to work in a traffic zone as part of their assigned duties. Employees parked a vehicle in a high traffic thoroughfare without adequate traffic control devices and / or flaggers as required in a work zone. The employer failed to provide signage and or flaggers in accordance with the Manual on Uniform Traffic Control Devices. Employees were thereby exposed to struck-by hazards. Abatement documentation is required for this item in accordance with 29 CFR 1903.19(d).

Signaling by flaggers, and the use of flaggers, including warning garments worn by flaggers shall conform to Part VI of the Manual on Uniform Traffic Control Devices, (1988 Edition, Revision 3 or the Millennium Edition), which are incorporated by reference in 29 CFR 1926.200(g)(2). a. On or about January 11, 2017, at the above referenced work site, employees were required to work in the roadway / Right of Way adjacent to a dedicated left turn lane. The employer failed to provide flaggers in accordance with the Manual on Uniform Traffic Control Devices. Employees were thereby exposed to struck-by hazards. Abatement documentation is required for this item in accordance with 29 CFR 1903.19(d).
