29 CFR 1910.23(c)(1): Open-sided floors and/or platforms four feet or more above adjacent floor or ground level were not guarded with standard railings (or equivalent) and toeboards:   a. On or about January 11, 2016, in the maintenance garage, east mezzanine, an open-sided platform did not have an adequate guardrail in that, a  portion of the open sided platform was guarded with a standard railing there by exposing employees to a fall hazard of up to six feet in height.    b. On or about January 11, 2016, in the maintenance garage, west mezzanine, an open-sided platform did not have an adequate guardrail in that, two portions open sided platform was not guarded with a standard railing there by exposing employees to a fall hazard of up to 9 feet in height.

29 CFR 1910.178(l)(2)(ii): The employer did not ensure that each operator had successfully completed the training consisting of a combination of formal instruction (e.g., lecture, discussion, interactive computer learning, video tape, written material), practical training (demonstrations performed by the trainer and practical exercises performed by the trainee), and evaluation of the operator's performance in the workplace.  29 CFR 1910.178(l)(2)(ii) is applicable to shipyard employment by 29 CFR 1915.120 that incorporates the general industry requirements.  On or about January 11, 2017, Mayea Marina Inc., an employee required to operate the forklift was not provided training on the safe operation of forklifts that included formal instruction, practical training and an evaluation of the operators performance in the workplace.
