1910.28(b)(2)(i) The employer must ensure that each employee in a hoist area is protected from falling 4 feet (1.2 m) or more to a lower level by a guardrail system, a personal fall arrest system, or a travel restraint system as required by 29 CFR 1910.28(b)(2)(i)(A) to 29 CFR 1910.28(b)(2)(i)(C).    Packaging lines department, overhead product receiving mezzanines: on or about January 25, 2017, employees (product dumpers) receiving palletized products at the overhead mezzanines were exposed to fall hazards over 9 feet likely to result in serious injury. Employees were assigned to remove horizontal chain at the edge of the platform without fall protection provided to allow for forklift operator to place load in the area.    There is no abatement documentation or certification required for this item.

29 CFR 1910.147(c)(6)(i): The employer did not conduct an annual or more frequent inspection of the energy control procedure to ensure that the procedure and requirements of this standard were followed:     Packaging lines department, packaging line no. 2, Hayssen Flexible Systems Pro Former: on or about January 11, 2017, the employer did not conduct, at least once per year, periodic inspection to identify and correct hazardous energy control (lockout) deviations or inadequacies in procedures and methods. Operators and maintenance personnel were regularly unjamming and re-feeding foil (servicing tasks) in the point-of-operation and associated danger zone on energized equipment while permitted to use a provided key to by-pass access doors safety interlocks. Employees had their fingers and hands exposed to machine caught-in hazards likely to result in serious injury.    Abatement documentation is required for this item in accordance with the requirements of 29 CFR 1903.19(d).

29 CFR 1910.147(d): The established procedure for the application of energy control (the lockout or tagout procedures) did not cover the actions listed in and was not done in sequence as required by 29 CFR 1910.147(d)(1)-(6):  Packaging lines department, packaging line no. 2, Hayssen Flexible Systems Pro Former: on or about January 11, 2017, operators and maintenance personnel performing regular unjamming and re-feeding foil (servicing tasks) in the point-of-operation and associated danger zones were not required to apply energy controls in the following sequence prior to starting work:   (a) prepare for shut down by recognizing energy hazards and its controls, (b) turn off and shut down the machines, (c) physically locate and operate energy isolating devices in such a manner as to isolate the machine or equipment from the energy source, (d) affix lockout or tagout devices to each energy isolating device, (e) render safe all potentially hazardous stored or residual energy, (f) verify that isolation and de-energization of the machine or equipment have been accomplished.  Employees assigned to perform servicing tasks on energized equipment were provided with a by-pass key to override access doors safety interlocks and had their hands and fingers exposed to machine caught-in hazards likely to result in serious injury where hazardous energy control (lockout/tagout) was not implemented.   Abatement documentation is required for this item in accordance with the requirements of 29 CFR 1903.19(d).

29 CFR 1910.305(b)(1)(ii): Unused openings in cabinets, boxes, and fittings shall be effectively closed.  Packaging lines department, cafeteria, wall mounted light switch electrical box: on or about January 11, 2017, employees were exposed to contact with live wires when turning on/off ceiling light and walking through the entry door next to the exposed energized light switch electrical box with a missing faceplate and a knockout where drywall opening was cut out.  There is no abatement certification or documentation required for this item.
