OSH ACT of 1970 Section (5)(a)(1): The employer does not furnish to each of his employees employment and a place of employment which are free from the recognized hazards of fire and/or explosion, which are causing or likely to cause death or serious physical harm to employees:     a. On or about January 9, 2017, and times prior thereto, at or near Area 9, Hot Work was performed on a 36-inch crude oil pipe without all energy isolating devices being adequately labeled or marked.         b. On or about January 9, 2017, and times prior thereto, at or near Area 9, Hot Work was performed on a 36-inch crude oil pipe without specific procedural steps for placement of lockout/tagout devices to energy isolating valves.          c. On or about January 9, 2017, and times prior thereto, at or near Area 9, Hot Work was performed on a 36-inch crude oil pipe without a lockout or tagout devices affixed to each energy isolating device by authorized employees.     d. On or about January 9, 2017, and times prior thereto, at or near Area 9, Hot Work was performed on a 36-inch crude oil pipe without all potentially hazardous residual energy being controlled to prevent re-accumulation.           e. On or about January 9, 2017, and times prior thereto, at or near Area 9, Hot Work was performed on a 36-inch crude oil pipe without verifying that isolation and de-energization had been achieved.           f. On or about January 9, 2017, and times prior thereto, at or near Area 9, Hot Work was performed on a 36-inch crude oil pipe without each member of a group installing their individually-controlled lock or tag.     g. On or about January 9, 2017, and times prior thereto, in the facility, hot work was performed on 36-inch crude oil pipe while using a Lansas Products Pipe Plug Part No 051-2036 and/or Cherne Industries Sewer Pipe Plug Part Nos. 317488/317408 and/or Plug Technologies Pipe Plug, Part No. 225-2448MGMS which were not designed for use with petroleum products nor designed for use during hot work.

29 CFR 1926.352(c): Welding, cutting, or heating was done where the application of flammable paints, or the presence of other flammable compounds, or heavy dust concentrations created a hazard:     On or about January 9, 2017, in Area 9 near Tank 250-4 where employees were exposed to a fire and explosion hazard when performing Hot Work on a 36-inch pipe that contained crude oil.
