OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to potential crushing hazards from falling loads and/or lift parts: (a) On January 12, 2017 for an employee who was exposed to crushing hazards where two Rotary model SP012N7T0 lateral lift arms did not have pads in place while servicing vehicles in the New Shop at or near 501 38th Street North in Fargo, North Dakota. (b) On January 12, 2017 for employees who were exposed to crushing hazards from using wooden blocks on four Challenger Lifts model CL10XP9 to lift and support vehicles in the Express Shop at or near 501 38th Street North in Fargo, North Dakota. Abatement Note: Among other methods, one feasible and acceptable method of abatement would be to follow the requirements of ANSI/ALI ALOIM and manufacturers specification which includes, among other requirements, the following: 1. Institute a preventive maintenance program according to the manufacturers specifications. 2. Provide training to employees on proper use and care of the lifts. 3. Before placing the lift arms under the vehicle, inspect each arm and contact pad for cracks or other signs of damage. 4. Use adapters from manufacturers, do not use wood.

29 CFR 1910.305(g)(2)(iii): Flexible cords and cables were connected to devices and fittings so that strain relief was not provided to prevent pull from being directly transmitted to joints or terminal screws: (a) On January 12, 2017 for an employee who was exposed to electrical hazards from exposed wires on flexible cord pendant located approximately seven feet from the ground in the New Shop at or near 501 38th Street North in Fargo, North Dakota.
