Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to potential crushing hazards from falling loads and/or lift parts: (a) On January 11, 2017 for an employee who was exposed to crushing hazards where swing arm manual lock on Rotary L85817 model SPOA88-21lift was not locking swing arm in place while servicing vehicles at or near 3901 Second Avenue SW in Fargo, North Dakota. Abatement Note: Among other methods, one feasible and acceptable method of abatement would be to follow the requirements of ANSI/ALI ALOIM and manufacturers specification which includes, among other requirements, the following: 1. Institute a preventive maintenance program according to the manufacturers specifications. 2. Provide training to employees on proper use and care of the lifts. 3. Be sure to repair damaged parts. 4. Schedule and complete all periodic and annual inspections.
