29 CFR 1910.178(l)(2)(ii): The employer did not ensure that each operator had successfully completed the training consisting of a combination of formal instruction (e.g., lecture, discussion, interactive computer learning, video tape, written material), practical training (demonstrations performed by the trainer and practical exercises performed by the trainee), and evaluation of the operator's performance in the workplace: a) Shop Area; On or about December 15, 2016 and at times prior thereto, the employer exposed employees to struck-by hazards in that the employer failed to evaluate the performance of forklift operators prior to these employees being permitted to operate this equipment.

29 CFR 1910.1200(h)(3)(iv): The details of the hazard communication program developed by the employer, did not include an explanation of the safety data sheet, including the order of information and how employees could obtain and use the appropriate hazard information: a) Shop; On or about December 15, 2016 and at times prior thereto, the employer exposed employees to chemical hazards from including but not limited to freon, pipe dope, silicon, and vacuum pump oil. These employees were not provided the new information and training on the UN Global Harmonized System (GHS) to include Safety Data Sheets (SDS). Tillery Heating and Air Conditioning, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1910.1200(h)(3)(iv), which was contained in OSHA inspection number 1150962, citation number 2, item number 2, and was affirmed as a final order on November 10, 2016, with respect to a workplace located at 2360 South Forbes Drive, Montgomery, AL 36110.
