29 CFR 1910.212(a)(2): General requirements for machine guards. Guards shall be affixed to the machine where possible and secured elsewhere if for any reason attachment to the machine is not possible. The guard shall be such that it does not offer an accident hazard in itself. a) On or about January 13, 2017, the operator doors on the #4, #5, #9 and #10 Fabal Vertical Machining Centers were not interlocked and could be opened during the machining process. b) On or about January 13, 2017, the Special Mode switch keys were left in the switches on the #53, #54, #55 and #7R OKK VM Vertical Machining Centers. The Special Mode switch allows the operator doors to be opened during the machining process.

29 CFR 1910.1200(e)(1): Employers shall develop, implement, and maintain at each workplace, a written hazard communication program which at least describes how the criteria specified in paragraphs (f), (g), and (h) of this section for labels and other forms of warning, safety data sheets, and employee information and training will be met, and which also includes the following: 29 CFR 1910.1200(e)(1)(i): A list of the hazardous chemicals known to be present using a product identifier that is referenced on the appropriate safety data sheet (the list may be compiled for the workplace as a whole or for individual work areas); and, 29 CFR 1910.1200(e)(1)(ii): The methods the employer will use to inform employees of the hazards of non-routine tasks (for example, the cleaning of reactor vessels), and the hazards associated with chemicals contained in unlabeled pipes in their work areas. a) On or about January 13, 2017, the employer had not updated the written Hazard Communication Program to incorporate the changes made in 2012. Changes in the 2012 Hazard Communication Standard includes, but is not limited the following: changing the hazardous chemical labeling to the Global Harmonization System (GHS), changes between material safety data sheets and safety data sheets, and the required information and training employees must receive.

(Electronic access and other alternatives to maintaining paper copies of the safety data sheets are permitted as long as no barriers to immediate employee access in each workplace are created by such options.) a) On or about January 13, 2017, the employer had not been updating the collection of Material Safety Data Sheets (MSDS) and/or Safety Data Sheets (SDS) available to employees when new stock arrived and the MSDS or SDS had been changed or updated. Most MSDSs available to employees were over 10 years old.
