29 CFR 1910.134(c)(1): A written respiratory protection program that included the provisions in 29 CFR 1910.134(c)(1)(i) - (ix) with worksite specific procedures was not established and implemented for required respirator use:  (a) Dykes Body shop: On or about January 10, 2017 and at times prior thereto the employer failed to establish and implement a written respiratory protection program that included the provisions in 29 CFR 1910.134(c)(1)(i) - (ix) with worksite specific procedures for employees required to use tight fitting respirators when spray painting cars at the paint booth and repair shop.

29 CFR 1910.134(h)(2)(i): Respirators were not stored to protect them from damage, contamination, dust, sunlight, extreme temperatures, excessive moisture, and damaging chemicals or  were not packed or stored to prevent deformation of the facepiece and exhalation valve:  (a) Painting area: On or about January 10, 2017 and at times prior thereto the employer exposed spray painting employee to inhalation hazards in that the respirator used by the employee was not packed and stored appropriately to prevent contamination.   (b) Body shop area: On or about January 10, 2017 and at times prior thereto the employer exposed body technician employee to inhalation hazards in that the respirator used by the employee was not packed and stored appropriately to prevent contamination.

29 CFR 1910.1200(h)(1): Employees were not provided effective information and training on hazardous chemicals in their work area at the time of their initial assignment and whenever a new hazard that the employees had not been previously trained about was introduced into their work area:  (a) Dykes Body Shop: On and about January 10, 2017 and at times prior thereto the employer failed to provide employees with effective information and training on hazardous chemicals in their work area at the time of their initial assignment. Employees used different products that contained hazardous chemicals such as but not limited automotive paints, antifreeze coolant, rubbing compound which may cause allergic skin reaction; compressed oxygen gas which is an oxidizer; compressed acetylene gas which can cause rapid suffocation.
