29 CFR 1910.95(c)(1): The employer did not administer a continuing, effective hearing conservation program as described in 29 CFR 1910.9(c) through (o) whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level of 85 decibels measured on the A scale, or equivalently a dose of fifty percent:  a. On or about January 12th 2017, at the above addressed jobsite located at 3400 W 45th St. West Palm Beach, FL 33407, the employer did not implement an effective hearing conservation program for employees who were exposed to noise levels of 92.5% dose or an equivalent sound level of 89.4 dBA. The sampling was performed for 488 minutes and zero exposure was assumed for the un-sampled time of 120 minutes.  b. On or about January 12th 2017, at the above addressed jobsite located at 3400 W 45th St. West Palm Beach, FL 33407, the employer did not implement an effective hearing conservation program for employees who were exposed to noise levels of 83,43% dose or an equivalent sound level of 88.6 dBA. The sampling was performed for 493 minutes and zero exposure was assumed for the un-sampled time of 60 minutes.

29 CFR 1910.133(a)(1): The employer did not ensure that each affected employee uses appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors, or potentially injurious light radiation.  On or about January 12th, 2017, at the jobsite located at 3400 W 45th St West Palm Beach, FL 33014, the employer did not ensure that employees use appropriate eye protection when exposed to flying wood fragments.

29 CFR 1910.134(c)(2)(i): Respirator users were not provided with the information contained in Appendix D to 29 CFR 1910.134 when the employer determined that any voluntary respirator use was permissible:  On or about January 12th 2017, at the above addressed jobsite located at 3400 W 45th St. West Palm Beach, FL 33407, the employer did not provide employees, who voluntarily wore 3M N-95 filtering face-pieces, with the information contained in Appendix D.
