29 CFR 1910.134(d)(1)(iii): The employer did not identify and evaluate the respiratory hazard(s) in the workplace; including a reasonable estimate of employee exposures to respiratory hazards and identification of the contaminant's chemical state and physical form: (Construction Reference 1926.103)    a) Worksite - Employees use and are exposed to a variety of chemicals during stick welding including, but not limited to welding fumes from the Excalibur 7018 electrodes, acetylene, and oxygen. Employees conduct welding both indoors and outdoors. Employees generally wear respirators while welding indoors, but not outdoors. The employer has not evaluated the respiratory hazards on or about 1/19/2017.     Note:  The employer is required to submit abatement certification for this item in accordance with 29 CFR 1903.19.

29 CFR 1910.1200(e)(1): The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met: (Construction Reference: 1926.59)    a) Worksite - Employees use and are exposed to fumes from welding stick electrodes including, but not limited to Excalibur 7018 stick electrodes when stick welding. Employees also use and are exposed to gases such as, but not limited to oxygen and acetylene from the gas cylinders used during welding. Employees were not provided with a written Hazard Communication program on or about 1/19/2017.    Note:  The employer is required to submit abatement certification for this item in accordance with 29 CFR 1903.19.

29 CFR 1910.1200(h)(1): Employees were not provided effective information and training on hazardous chemicals in their work area at the time of their initial assignment and whenever a new hazard that the employees had not been previously trained about was introduced into their work area: (Construction Reference: 1926.59)  a) Worksite - Employees use and are exposed to fumes from welding stick electrodes including, but not limited to Excalibur 7018 stick electrodes when stick welding. Employees also use and are exposed to gases such as, but not limited to oxygen and acetylene from the gas cylinders used during welding. Employees did not received updated hazard communication training on or about 1/19/2017.  Note:  The employer is required to submit abatement certification for this item in accordance with 29 CFR 1903.19.
