29 CFR 1926.1203(a): Before it began work at a worksite, the employer did not ensure that a competent person identified all confined spaces in which one or more of the employees it directed may have worked, and/or did not identify each space that was a permit space, through consideration and evaluation of the elements of that space, including testing as necessary: The employer did not ensure that a competent person identified all confined spaces and identified each space that was a permit space as required at the worksite located at 3535 Becker-Joerling Road, Foristell, MO. A septic tank technician was trapped for approximately twenty-six hours when he slipped and fell inverted into the septic tank aerator riser during aerator installation. Or, In the Alternative: 29 CFR 1910.146(c)(1): The employer did not evaluate the workplace to determine if any spaces were permit-required confined spaces: For the septic tank technician who performs septic tank system warranty services, the employer did not adequately evaluate the workplace to determine that residential septic tanks are permit-required confined spaces.
