29 CFR 1910.95(c)(1): The employer did not administer a continuing, effective hearing conservation program as described in 29 CFR 1910.95(c) through (o) whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level of 85 decibels measured on the A scale, or equivalently a dose of fifty percent: Employees were exposed to hazards associated with exposure to excessive noise. The employer had not implemented an effective hearing conservation program for employees exposed to noise above 85 decibels. Employees working in the following locations were exposed to noise equal to or exceeding an 8-hour time-weighted average sound level of 85 decibels measured on the A scale. (1) An employee working at the big mill was exposed to continuous noise levels at 155% of the allowable 8-hour time-weighted average sound level of 85 dBA or an equivalent sound level of approximately 93.1 dBA. The sampling was performed for 459 minutes during one shift on March 16, 2017. (2) An employee working at the rip saw area was exposed to continuous noise levels at 72.3% of the allowable 8-hour time-weighted average sound level of 85 dBA or an equivalent sound level of approximately 87.6 dBA. The sampling was performed for 235 minutes during one shift on March 16, 2017. (3) An employee working at the big mill was exposed to continuous noise levels at 211.9% of the allowable 8-hour time-weighted average sound level of 85 dBA or an equivalent sound level of approximately 95.4 dBA. The sampling was performed for 452 minutes during one shift on March 16, 2017. (4) An employee working at the big mill was exposed to continuous noise levels at 135.3% of the allowable 8-hour time-weighted average sound level of 85 dBA or an equivalent sound level of approximately 92.1 dBA. The sampling was performed for 449 minutes during one shift on March 16, 2017. Audiometric testing had not been provided to assess the effects of noise exposure on employee hearing.
