29 CFR 1926.100(a): Employees working in areas where there was a possible danger of head injury from impact, or falling or flying objects, or from electrical shock and burns, were not protected by protective helmets:  (a) David Miller dba DAM Construction on or about January 18, 2017, at the address of 11815 Twp Rd. 145 Findlay, OH: The employer did not ensure employees were protected from head injuries while walking/working below employees operating from aerial lifts above. Employees were exposed to potential impact injuries caused from falling material and/or equipment.

29 CFR 1926.453(b)(2)(v): A body belt with lanyard attached to the boom or basket was not worn by employee(s) working from an aerial lift:  a) David Miller dba DAM Construction on or about January 18, 2017, at the address of 11815 Twp Rd. 145 Findlay, OH: The employer did not ensure an employee working from an aerial lift was adequately protected from falls.  The employee working from the lift was not tied off to the basket while the platform was elevated. The employee was exposed to falls up to 25 feet to the ground below.

29 CFR 1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems.  (a)  David Miller dba DAM Construction on or about January 18, 2017, at the address of 11815 Twp Rd. 145 Findlay, OH: The employer did not ensure an employee installing siding material from an elevated roof deck was adequately protected from falls. The employee fastening siding trim from the elevated surface without the benefit of fall protection was exposed to a 10ft. fall to the ground level below.

29 CFR 1926.503(b)(1): The employer did not verify compliance with paragraph (a) of this section by preparing a written (training) certification record including the name or other identity of the employee trained, the date(s) of the training, and the signature of the person who conducted the training or the signature of the employer.  a) David Miller dba DAM Construction on or about January 18, 2017, at the address of 11815 Twp Rd. 145 Findlay, OH:  The employer did not develop or maintain a written record of fall protection training certification for all employees who might be exposed to fall hazards. The employer failed to evaluate the adequacy and certify fall protection training that employees had participated through the general contractor onsite and/or current employer.
