29 CFR 1910.147(c)(6)(i): The employer shall conduct a periodic inspection of the energy control procedure at least annually to ensure that the procedure and the requirements of this standard are being followed. (a) On or about January 12, 2017, the employer did not conduct periodic inspections of authorized employees and the energy control procedures to ensure employees were familiar with their responsibilities under the procedure and the procedures were still accurate. This exposed employees to the accidental/inadvertent restart of equipment.

29 CFR 1910.212(a)(2): General requirements for machine guards. Guards shall be affixed to the machine where possible and secured elsewhere if for any reason attachment to the machine is not possible. The guard shall be such that it does not offer an accident hazard in itself. (a) On or about January 12, 2017; in Plant 2, the Karl Schnell (ZUFUHRBEAHALTER 900, M-Nr. 14687) cooker/surge tank had a cover approximately 10'-4" with four latches. The cover was not secured nor equipped with safety devices to stop the rotating auger when opened exposing employees to struck-by hazards.

29 CFR 1910.212(a)(3)(ii): The point of operation of machines whose operation exposes an employee to injury, shall be guarded. The guarding device shall be in conformity with any appropriate standards therefor, or, in the absence of applicable specific standards, shall be so designed and constructed as to prevent the operator from having any part of his body in the danger zone during the operating cycle. (a) On or about January 12, 2017; in Plant 1, Line 1, employees placing blocks of cheese into the grinder were not protected from an unguarded auger. (b) On or about January 12, 2017; in Plant 1, Line 2, employees placing blocks of cheese into the grinder were not protected from an unguarded auger.
