29 CFR 1910.23(c)(1): Every open-sided floor or platform 4 feet or more above adjacent floor or ground level shall be guarded by a standard railing (or the equivalent as specified in paragraph (e)(3) of this section)on all open sides except where there is an entrance to a ramp, stairway, or fixed ladder: (a) On or about December 30, 2016, a driver was exposed to a fall in excess of four feet, while standing on an industrial scissors lift, unloading and loading a tractor trailer at CVS, 124 S. Main Street, Union, Ohio. In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification. This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence, or written records.

29 CFR 1910.132(d)(1): The employer shall assess the workplace to determine if hazards are present, or are likely to be present, which necessitate the use of personal protective equipment (PPE). If such hazards are present, or likely to be present, the employer shall: (a) The employer failed to conduct a workplace hazard assessment for the tractor trailer delivery drivers. 29 CFR 1904.39(a)(1): Basic Requirement. Within eight (8) hours after the death of any employee as a result of a work-related incident, you must report the fatality to the Occupational Safety and Health Administration (OSHA), U.S. Department of Labor: (a) The employer did not report a fatality within eight hours of the occurrence, in that on December 31, 2016, an employee passed away as the result of a workplace accident. The fatality was not reported by the employer until January 23, 2017. In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification.
