29 CFR 1910.146(c)(7)(iii): The employer shall document the basis for determining that all hazards in a permit space have been eliminated, through a certification that contains the date, the location of the space, and the signature of the person making the determination. The certification shall be made available to each employee entering the space or to that employee's authorized representative.    a) On or about January 25, 2017, employees entering the Wheelabrator were not consistently documenting the hazards within the Wheelabrator had been eliminated and the elements of the employer's written Confined Space Procedure had been implemented.

29 CFR 1910.212(a)(1): Types of guarding. One or more methods of machine guarding shall be provided to protect the operator and other employees in the machine area from hazards such as those created by point of operation, ingoing nip points, rotating parts, flying chips and sparks. Examples of guarding methods are-barrier guards, two-hand tripping devices,electronic safety devices, etc.    a) On or about January 25, 2017, the Parts Cleaner working at the Parts Cleaning Table 116 inches from the Flame Cutting Table was not protected from the sparks generated when the torch cutting head flame was piercing the steel plate. Sparks generated while piercing the metal plate near the aisle way between the Flame Cutting Table and Parts Cleaning Table fly onto the Parts Cleaning Table.    b) On or about January 25, 2017, a hole in the metal housing of the Wheelabrator allowed abrasive blast to exit the Wheelabrator and potentially strike the Wheelabrator Operator.

29 CFR 1910.134(k)(6): The basic advisory information on respirators, as presented in Appendix D of this section, shall be provided by the employer in any written or oral format, to employees who wear respirators when such use is not required by this section or by the employer.  a)  On or about January 25, 2017, the employer had not trained employees voluntarily wearing 3M Home Dust Masks on the information contained in Appendix D of 29 CFR 1910.134.

29 CFR 1910.1200(h)(1):     Employers shall provide employees with effective information and training on hazardous chemicals in their work area at the time of their initial assignment, and whenever a new chemical hazard the employees have not previously been trained about is introduced into their work area. Information and training may be designed to cover categories of hazards (e.g., flammability, carcinogenicity) or specific chemicals. Chemical-specific information must always be available through labels and safety data sheets.
