29 CFR 1910.147(c)(1): The employer did not establish a program consisting of an energy control procedure, employee training and periodic inspections to ensure that before any employee performed any servicing or maintenance on a machine or equipment where the unexpected energizing, startup or release of stored energy could occur and cause injury, the machine or equipment shall be isolated from the energy source and rendered inoperative: a) Mill: On January 23, 2017 and at times prior, employees were exposed to amputation hazards while conducting maintenance activities on machines such as but not limited to the pellet mill, leg augers, transfer augers, and a conveyor belt.

29 CFR 1910.134(c)(2)(ii): The employer did not establish and implement those elements of a written program necessary to ensure that any employee using a respirator voluntarily was medically able to use that respirator, and that the respirator was cleaned, stored, and maintained so that its use does not present a health hazard to the user: a) Mill: On January 23, 2017 and at times prior, employees were wearing 3M Half Mask Elastomeric respirators with filtering cartridges without having had a medical evaluation prior to use. b) Mill: On January 23, 2017 and at times prior, employees were wearing 3M Half Mask Elastomeric respirators with filtering cartridges without having had a fit test prior to use.
