29 CFR 1926.1053(b)(13): The top or top step of a stepladder was used as a step: a) At 5689 Bear Point Ave. Orange Beach, Alabama: On or about January 25, 2016 and at times prior; the employer allowed his employees to use an a-frame ladder to get on and off the ceiling joists requiring them to step on the top step of the ladder exposing them to a fall hazard of 6 feet to the floor below.

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b): a) At 5689 Bear Point Ave. Orange Beach, Alabama: On or about January 25, 2016 and at times prior; the employer allowed his employees to work from the top plate of framed walls on the second floor of a residential home without fall protection exposing them to a fall hazard of 20 feet 7 inches to the ground below. THE JUAN IBARRA DBA JUAN IBARRA WAS PREVIOUSLY CITED FOR A VIOLATION OF THIS OCCUPATIONAL SAFETY AND HEALTH STANDARD OR ITS EQUIVALENT STANDARD 29 CFR 1926.501(B)(13), WHICH WAS CONTAINED IN OSHA INSPECTION NUMBER 1125699 CITATION NUMBER 1, ITEM NUMBER 1, AND WAS AFFIRMED AS A FINAL ORDER ON NOVEMBER 17, 2016, WITH RESPECT TO A WORKPLACE LOCATED AT 10455-A GOODRICH WAY LOT 34 WATERFORD SUBDIVISION, DAPHNE, ALABAMA.
