WAS  PREVIOUSLY  CITED  FOR  A  VIOLATION  OF  THIS  OCCUPATIONAL SAFETY  AND  HEALTH STANDARD  OR  ITS  EQUIVALENT STANDARD, WHICH WAS CONTAINED IN OSHA INSPECTION NUMBER 1106654, CITATION NO. 1, ITEM NO.  1,  AND WAS AFFIRMED AS A FINAL ORDER ISSUED ON 02/01/2016, WITH RESPECT TO A WORKPLACE LOCATED  AT  1569 NIAGARA FALLS BOULEVARD,  AMHERST,  NY 14226.       29 CFR 1926.451(e)(1): When scaffold platforms were more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from other scaffold, structure, personnel hoist, or similar surface was not used.  Crossbraces were used as a means of access.      a) On or about 1/25/17, on the Five Guys Addition construction site at 5716 S. Transit Rd., Lockport, NY, where a masonry wall was under construction:  An employee was exposed to a potential fall of up to 14 ft. 3 in. while climbing up/down the frame of the tubular welded frame masonry type scaffold to access/exit the second level of the scaffold.  There was an extension ladder present that provided a safe access/exit means to/from the ground to first level, but no safe access means was provided from the ground to the second level.         NO ABATEMENT DOCUMENTATION REQUIRED
