29 CFR 1926.34(c): "Maintenance and workmanship." Means of egress shall be continually maintained free of all obstructions or impediments to full instant use in the case of fire or other emergency. 1) Jobsite/ Top of the building: The employer did not have a clear unobstructed means of egress to access in and out of the scaffold used by employees engaged in construction activities. A metal grate was in the path leaning against a wall preventing free access in the event of an emergency. Condition was observed on or about 10/18/16.

29 CFR 1926.451(e)(1): When scaffold platforms are more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from another scaffold, structure, personnel hoist, or similar surface shall be used. Crossbraces shall not be used as a means of access. 1) Jobsite/Top of the building: The employer did not ensure employees had safe scaffold access. An employee had to climb over a wall to access the working level of a scaffold exposing the employee to a fall hazard. Condition was noted on or about 10/18/16.
