29 CFR 1910.37(a)(3): Exit routes must be free and unobstructed. No materials or equipment may be placed, either permanently or temporarily, within the exit route. The exit access must not go through a room that can be locked, such as a bathroom, to reach an exit or exit discharge, nor may it lead into a dead-end corridor. Stairs or a ramp must be provided where the exit route is not substantially level.  a) Exit doors were blocked with pallets of batteries in the battery charging room, in that employees would not be able to use the exit doors in case of emergency.    b) An Exit door located next to the large overhead door was blocked with materials, in that employees would not be able to use the exit doors in case of emergency.

29 CFR 1910.132(a): Application. Protective equipment, including personal protective equipment for eyes, face, head, and extremities, protective clothing, respiratory devices, and protective shields and barriers, shall be provided, used, and maintained in a sanitary and reliable condition wherever it is necessary by reason of hazards of processes or environment, chemical hazards, radiological hazards, or mechanical irritants encountered in a manner capable of causing injury or impairment in the function of any part of the body through absorption, inhalation or physical contact.  a) Employer did not provide fall protection for employees that are climbing into the racking system to retrieve batteries from the tiers resulting in a fall hazard greater than 12 feet.

The operator's performance were not reevaluated every three years.
