29 CFR 1926.451(e)(1): When scaffold platforms were more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from other scaffold, structure, personnel hoist, or similar surface was not used. Cross braces were used as a means of access: (a) The employer did not ensure that each employee working off of tubular welded frame scaffolding built over two tiers high was accessing it properly; employees used cross braces while climbing up and down the scaffolding exposing them to a fall hazard of approximately thirteen (13) feet.

29 CFR 1926.451(g)(1)(vi): Each employee performing overhand bricklaying operations from a supported scaffold was not protected from falling from all open sides and ends of the scaffold (except at the side next to the wall being laid) by the use of a personal fall arrest system or guardrail system (with minimum 200 pound toprail capacity): (a) The employer did not ensure that each employee performing overhand bricklaying operations off a tubular welded frame scaffold approximately thirteen (13) feet above the ground level below were protected from a fall hazard by the use of personal fall arrest system or guardrail system. The scaffolding only had cross bracing installed acting as a top rail and no mid rail.
