OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck-by hazards: On or about 1/26/2017 in the warehouse at the Y-Zone and other storage rack areas at 5944 Peachtree Corners East, Norcross, GA: Employees were exposed to a struck-by hazards from the storage rack system supports and shelves being visibly damaged and not permanently affixed to the floor. Pallet boxes of one gallon liquids containers and various automotive parts were being stored on the damage racks.

29 CFR 1910.176(a): Where mechanical handling equipment is used, sufficient safe clearances were not provided in aisle ways. Aisles and passageways were not kept clear with no obstructions across or in aisles creating a hazard. On or about 1/26/2017 in the warehouse, receiving, and shipping at 5944 Peachtree Corners East, Norcross, GA: Aisles and passageways in certain areas were not marked or identified for all employees walking and working in the areas that were pulling, storing, and transporting the product. The employer failed to ensure aisles and passageways were appropriately marked and not obstructed by material to prevent the employee from being exposed to a struck-by hazard.
