OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that an employee was exposed to struck by hazards posed by active operations of a Caterpillar 420E Backhoe Loader: a) 12 Lake Ave., Worcester, MA: on or about January 20, 2017, an employee was struck by the bucket of a Caterpillar 420E and caught between that bucket and the adjacent building. Among other methods, feasible and acceptable means to correct this hazard is to comply with Caterpillar's Operation and Maintenance Manual for the 420E Backhoe Loader, which includes, but is not limited to the following: 1. Before Operation - Clear all personnel from the machine and the work area. 2. Operation - Before you move the machine, make sure that no one will be endangered. Specific abatement documentation that this violation has been corrected must be provided within 10 days of the abatement in accordance with 29 CFR 1903.19(d)(1).
