29 CFR 1910.95(c)(1): The employer did not administer a continuing, effective hearing conservation program as described in 29 CFR 1910.9(c) through (o) whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level of 85 decibels measured on the A scale, or equivalently a dose of fifty percent: (a) At workstation A, on or about January 24, 2017, a hearing conservation program was not implemented for the employee who was exposed to noise at 243% of the action level (8-hour time-weighted average sound level of 85 dBA) or an equivalent sound level of 91.4 dBA during the 426 minute sampling period, resulting in a noise hazard. (b) At workstation C, on or about January 24, 2017, a hearing conservation program was not implemented for the employee who was exposed to noise at 220% of the action level (8-hour time-weighted average sound level of 85 dBA) or an equivalent sound level of 90.6 dBA during the 424 minute sampling period, resulting in a noise hazard. (a) At workstation B, on or about January 24, 2017, a hearing conservation program was not implemented for the employee who was exposed to noise at 212% of the action level (8-hour time-weighted average sound level of 85 dBA) or an equivalent sound level of 90.4 dBA during the 442 minute sampling period, resulting in a noise hazard.

29 CFR 1910.133(a)(3): 29 CFR 1910.133(a)(3): The employer did not ensure that each affected employee who wore prescription lenses while engaged in operations that involved eye hazards wore eye protection that incorporated the prescription in its design, or wore eye protection that could be worn over the prescription lenses without disturbing the proper position of the prescription lenses or the protective lenses. (a) In the production area, on or about January 24, 2017 and at times prior to, an employee exposed to eye hazards (nails from pneumatic nail guns and wood debris) was not provided with protective eyewear to use in place of, or over, the employee's prescription glasses.
