29 CFR 1926.602(d): The employer did not ensure that each employee operating a powered industrial vehicle had been trained and evaluated as required by paragraph 29 CFR 1910.178(l):Note: The requirements applicable to construction work under paragraph (d) of this section are identical to those set forth at paragraph (l) of 29 CFR 1910.178. and as referenced by the note contained in 1926.602(d). On 1/18/2017, MC Hotel Construction had not ensured a subcontractor employee was competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the required training. The sub-contractor employee, who had not completed the required training, was operating MC Hotel Constructions Caterpillar Telehandler, Model TL1055D, to facilitate roofing work on a building located at 150 Wentzville Bluffs Drive, Wentzville, MO.
