29 CFR 1910.95(c)(1): The employer did not administer a continuing, effective hearing conservation program as described in 29 CFR 1910.9(c) through (o) whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level of 85 decibels measured on the A scale, or equivalently a dose of fifty percent:  a) B & M Pallet Co., Inc., Statham, GA - An employee repairing pallets using a pneumatic nail gun and hammer, was exposed to noise at a time-weighted average (TWA) of 98.6 dBA. The exposure was derived by a sample taken over 434 minutes. Zero exposure was assumed for the 46 minutes unsampled period. A hearing conservation program to include enforcing the use of hearing protection, performing hearing test, the establishment of a noise monitoring program and conducting noise training, was not established ,on or about 2/9/17.   b) B & M Pallet Co., Inc., Statham, GA - An employee repairing pallets using a pneumatic nail gun and hammer, was exposed to noise at a time-weighted average (TWA) of 94.1 dBA. The exposure was derived by a sample taken over 436 minutes. Zero exposure was assumed for the 44 minutes unsampled period. A hearing conservation program to include enforcing the use of hearing protection, performing hearing test, the establishment of a noise monitoring program and conducting noise training, was not established ,on or about 2/9/17.  c) B & M Pallet Co., Inc., Statham, GA - An employee repairing pallets using a pneumatic nail gun and hammer, was exposed to noise at a time-weighted average (TWA) of 93.5 dBA. The exposure was derived by a sample taken over 437 minutes. Zero exposure was assumed for the 43 minutes unsampled period. A hearing conservation program to include enforcing the use of hearing protection, performing hearing test, the establishment of a noise monitoring program and conducting noise training, was not established ,on or about 2/9/17.   d) B & M Pallet Co., Inc., Statham, GA - An employee repairing pallets using a pneumatic nail gun and hammer, was exposed to noise at a time-weighted average (TWA) of 94.2 dBA. The exposure was derived by a sample taken over 432 minutes. Zero exposure was assumed for the 48 minutes unsampled period. A hearing conservation program to include enforcing the use of hearing protection, performing hearing test, the establishment of a noise monitoring program and conducting noise training, was not established ,on or about 2/9/17.   e) B & M Pallet Co., Inc., Statham, GA - An employee repairing pallets using a pneumatic nail gun and hammer, was exposed to noise average of 96.8 dBA. The exposure was derived by a sample taken over 240 minutes which represented the employee's 8-hour workday. A hearing conservation program to include enforcing the use of hearing protection, performing hearing test, the establishment of a noise monitoring program and conducting noise training, was not established ,on or about 2/9/17.   f) B & M Pallet Co., Inc., Statham, GA - An employee cutting wood using a chop saw and working in the storage area, was exposed to noise at a time-weighted average (TWA) of 88.7 dBA. The exposure was derived by a sample taken over 435 minutes. Zero exposure was assumed for the 45 minutes unsampled period. A hearing conservation program to include enforcing the use of hearing protection, performing hearing test, the establishment of a noise monitoring program and conducting noise training, was not established ,on or about 2/9/17.
