29 CFR 1910.134(e)(1): The employer did not provide a medical evaluation to determine the employee's ability to use a respirator, before the employee was fit tested or required to use the respirator in the workplace:  (a) At the facility, on or about 2/24/2016:  Where several employees were required to use half face cartridge respirators for certain tasks, including spray painting autos the employees had not been provided with up to date medical evaluations to insure their ability to use the respiratory protection.

29 CFR 1910.1200(e)(1): The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met:  (a)    At the shop, on or about 02/24/2017:  The employer had no written hazard communication program, an incomplete SDS inventory, and no formal training implemented at this worksite where the employees used paints, solvents and other body shop products, containing irritant and combustible components.    Abatement certification must be submitted.
