29 CFR 1910.178(l)(2)(ii): The employer did not ensure that each operator had successfully completed the training consisting of a combination of formal instruction (e.g., lecture, discussion, interactive computer learning, video tape, written material), practical training (demonstrations performed by the trainer and practical exercises performed by the trainee), and evaluation of the operator's performance in the workplace. (a) In the yard: On January 31, 2017 and at times prior thereto the employer exposed employees to struck-by hazards in that employees were allowed to operate powered industrial trucks without the employer first ensuring that the employees were competent to operate the equipment as demonstrated by the completion of the required training and evaluation specified in the standard.

(b) On or about January 31, 2017 and at times prior thereto the employer exposed employees to struck-by hazards by failing to ensure that Omega forklift model: 2214-10; serial number: OM589TWS; rated capacity: 17,900lbs was examined daily before being placed in service.
