29 CFR 1926.28(a): The employer did not require the wearing of appropriate personal protective equipment in all operations where there is an exposure to hazardous conditions. At the Manu'a construction worksite, the heavy equipment operator clearing and preparing the ground for the new building was not wearing a seat belt and was exposed to struck-by and caught between hazards.
