29 CFR 1926.150(a)(1): The employer did not develop and maintain a fire protection program to be followed throughout all phases of construction and demolition work, and/or did not provide for the firefighting equiment as specified in this subpart:   (a)   On or about 01/19/17, at the Village Gate complex, located at 274 North Goodman Street, in Rochester, New York, during a roof repair project, employees were not provided with fire protection or with fire extinguishers while working with flammable liquids (Karnak flashing cement and Low Voc Primer) and using a "Roof Master" (power roof saw) an ignition source.  NO ABATEMENT CERTIFICATION REQUIRED

29 CFR 1926.502(h)(1)(v): The safety monitor had other responsibilities which could take the monitor's attention from the monitoring function:   (a)  On or about 01/19/17, at the Village Gate complex, located at 274 North Goodman Street, in Rochester, New York, during a roof repair project; the designated roof monitor was engaged in other work including the operation of a SKYTRACK "telehandler" to hoist roofing materials up to the roof. 29 CFR 1926.502(h)(2): Mechanical equipment was used and stored in an area where a safety monitoring system was used to protect employees who were involved in roofing operations:  (a)  On or about 01/19/17, at the Village Gate complex, located at 274 North Goodman Street, in Rochester, New York, during a roof repair project , a roof cutter machine was in use and was being stored in the work area, while employees were working under the guidance of a safety monitoring program.  NO ABATEMENT CERTIFICATION REQUIRED

29 CFR 1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed:   (a)   On or about 01/19/17, at the Village Gate complex, located at 274 North Goodman Street, in Rochester, New York, during a roof repair project ,  a portable ladder was used by employees an upper level roof 10 feet above an intermediate roof did not have its ladder rails three (3) feet above the upper level landing.  NO ABATEMENT CERTIFICATION REQUIRED
