29 CFR 1926.21(b)(2): The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his work environment to control or eliminate any hazards or other exposure to illness or injury.  a) The employer did not instruct employees in methods to control or eliminate potential cave-in hazards prior to working in trenches and excavations.   Employees were working to install a sewer line in a trench at a depths ranging from 5.0 to 10 1/2 feet.  Abatement certification AND documentation are required for this item.

29 CFR 1926.651(c)(2):  A stairway, ladder, ramp or other safe means of egress was not located in trench excavations that are 4 feet (1.22 m) or more in depth so as to require no more than 25 feet (7.62 m) of lateral travel for employees.  a) The employer did not ensure the use of an appropriate ladder or other safe means of egress while employees were working to install a sewer line in a trench at a depth ranging from 5.0-10 1/2 feet.  Employees jumped in as ingress and/or climbed out from the walls of the trench on the southeast corner of the trench as ingress/egress from the work location.     Abatement certification AND documentation are required for this item.

29 CFR 1926.651(k)(1): Daily inspections of excavations, the adjacent areas, and protective systems were not made by a competent person for evidence of a situation that could result in possible cave-ins, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions.  Inspections were not conducted by the competent person prior to the start of work and as needed throughout the shift.  a) For the trench excavated approximately 60 linear feet from north to south on this commercial site, the employer did not ensure a "competent person" inspected trenches and excavations prior to the start of work and as needed throughout the shift.  Employees were working to install a sewer line in an excavation at a depth ranging from 5.0 to 10.5 feet.  Inspections were not completed for the potential cave-in hazards on the site.   Abatement certification AND documentation are required for this item.

Abatement certification and documentation ARE required for this item.     Steve Bruneel dba SC Construction, LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.651(j)(2), which was contained in OSHA inspection number 531258, citation number 1, item number 1b and was affirmed as a final order on August 18, 2012, with respect to a workplace located at 8600 Franklin Rd., Boise, ID 83709.

Abatement certification and documentation ARE required for this item.
