29 CFR 1926.20(b)(1): It shall be the responsibility of the employer to initiate and maintain such programs as may be necessary to comply with this part.  a. On or before February 2, 2017, the employer failed to initiate and maintain a fall protection program, thereby exposing employees to 17 foot fall hazards.  b. On or before February 2, 2017, the employer failed to initiate and maintain a safety program that identified hazards present and the personal protective equipment required to prevent injuries from those hazards, thereby exposing employees' eyes to struck-by hazards.

29 CFR 1926.102(a)(1): The employer shall ensure that each affected employee uses appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors, or potentially injurious light radiation.  a. On or before February 2, 2017, the employer did not require the use of eye protection during roofing work where employees used air actuated nail guns. This violation was most recently observed at Building 14K of the Powell Grand development, Powell, OH 43065, where two employees' eyes were not protected from struck-by hazards.  To abate this violation, the employer must ensure that the eyes of employees performing roofing work with nail guns are protected from struck-by hazards and that no employee is allowed to use nail guns without eye protection.  J. Braulio Sierra was previously cited for a violation of this Occupational Safety and Health standard, 29 CFR 1926.102(a)(1), which was contained in OSHA inspection numbers:  1. 836504, Repeat-Serious, Citation 2, Item 1, Final order on 5/2/2103 2. 607919, Serious, Citation 1, Item 1, Final order on 4/1/2013  Pursuant to 29 C.F.R 1903.19, the employer must submit documents describing the steps it is taking to ensure compliance, including a description of how these steps protect its employees from the fall hazards.

29 CFR 1926.501(b)(13): "Residential construction." Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure. Exception: When the employer can demonstrate that it is infeasible or creates a greater hazard to use these systems, the employer shall develop and implement a fall protection plan which meets the requirements of paragraph (k) of 1926.502. Note: There is a presumption that it is feasible and will not create a greater hazard to implement at least one of the above-listed fall protection systems. Accordingly, the employer has the burden of establishing that it is appropriate to implement a fall protection plan which complies with 1926.502(k) for a particular workplace situation, in lieu of implementing any of those systems.  a. On or before February 2, 2017, the employer did not require the use of any form of fall protection during roofing work. This violation was most recently observed at Building 14K of the Powell Grand development, Powell, OH 43065, where three employees were not protected from fall hazards of 10 feet, 6 inches to the ground.   To abate this violation, the employer must ensure that its employees performing roofing work are protected from falls, and that no employee is allowed onto a roof more than six feet high without adequate fall protection.  J. Braulio Sierra was previously cited for a violation of this Occupational Safety and Health standard or its equivalent standard 29 CFR 1926.501(b)(13) which contained in OSHA inspection numbers:  1. 836504, Repeat-Serious, Citation 2, Item 2, Final order on 5/2/2103 2. 607919, Repeat-Serious, Citation 2, Item 1, Final order on 4/1/2013 3. 279657, Serious, Citation 1, Item , Final order 3/7/2012  Pursuant to 29 C.F.R 1903.19, the employer must submit documents describing the steps it is taking to ensure compliance, including a description of how these steps protect its employees from the fall hazards.
