29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems, or an alternative fall protection measure under another provision of paragraph 1926.501 (b), nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502: (a) Reynolds Square Townhomes, Unit #7 third floor top plate: On or about January 31, 2017, and at times prior, the employer exposed employees to fall hazards of 31-feet, 7-inches, in that a fall protection system was not provided while installing ceiling joists.

29 CFR 1926.1052(c)(1)(ii): Stairways having four or more risers or rising more than 30 inches (76 cm), whichever is less, were not equipped with a stairrail system along each unprotected side or edge: (a) Reynolds Square Townhomes, Unit #7 stairway: On or about January 31, 2017, and at times prior, the employer exposed employees to fall hazards of approximately 7-feet to the lower concrete surface, in that stair rails were not installed along the open side of the stairway as employees used this stairway to access the upper levels of the structure to perform framing activities.
