29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure. Exception: When the employer can demonstrate that it is infeasible or creates a greater hazard to use these systems, the employer shall develop and implement a fall protection plan which meets the requirements of paragraph (k) of 1926.502. Located along the front porch stud framed top plate of the residential structure an employee is observed performing truss erection associated activities adjacent to unprotected perimeter exterior sides or edges of the top plate and unprotected areas of the interior lower cord of the truss without conventional fall protection systems and was exposed to fall potentials in excess of 11 feet.

29 CFR 1926.1053(b)(6): Ladders shall be used only on stable and level surfaces unless secured to prevent accidental displacement. Located along the residential interior stud framed porch an employee accessed stud framed truss and top plate areas utilizing an approximate 6 foot blue Werner step ladder laid folded flat against an exterior porch wall with the ladder top directly below the porch truss lower cord. The ladder is not secured from being displaced and is base supported by the lower portion bottom ladder rung setting flat and straddling an approximate 2X8 framing board without any of the ladders feet surface being supported exposing the ladder to becoming displaced and an employee fall potential in excess of 6 foot.
