29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system: On or about February 3, 2017, and at times prior thereto, workers framing in trusses on the second story did not use personal fall protection and were not protected from falling by other means such as guardrails. The workers did not have safety rules enforced upon them and were subject to falling over six feet in elevation to the ground below.

29 CFR 1926.602(c)(1)(ii): Modifications or additions which affect the capacity or safe operation of the equipment were made without the manufacturer's written approval. Were modifications or changes were made, the capacity, operation, and maintenance instruction plates, tags, or decals were not changed accordingly. In no case shall the original safety factor of the equipment be reduced. On or about February 3, 2017, and at times prior thereto, the employer fabricated a job-made, wooden trash box for an attachment to the front of the rough terrain forklift. The box was not constructed by a qualified person; it did not identify its tare weight or load capacity; it did not positively engage the forks; and it created an unstable load and struck-by hazard.
