29 CFR 1926.451(e)(8): Direct access to or from another surface was used when the scaffold was more than 14 inches (36 cm) horizontally and/or 24 inches (61 cm) vertically from the other surface: (a) ACE Canopy Erectors, Inc. on or about February 08, 2017, at the address of 1814 E. Perry St. Port Clinton, OH: The employer did not ensure a safe means of access/egress to and from the fueling station canopy was provided to employees. During steel erection work, an employee was utilizing a truck mounted lift platform to gain access to the elevated work area. The employee was required to step more than 4.5 ft. vertically from the scaffolding platform to access the working level above. This employee was exposed to a near 14.5 ft. fall to the ground below.

29 CFR 1926.451(g)(1): Employees on scaffolds more than 10 feet (3.1 m) above a lower level were not protected from falling to that lower level by fall protection established in paragraphs (g)(1)(i)-(vii) of this section: (a) ACE Canopy Erectors, Inc. on or about February 08, 2017, at the address of 1814 E. Perry St. Port Clinton, OH: The employer did not ensure an employee working from a truck mounted truck platform was adequately protected from falls. At least one employee was not tied off to the platform and was observed standing atop the mid and toprail to access the elevated canopy deck, effectively bypassing fall protection measures. The employee operating in this condition was exposed to an approximate 14.5 ft. fall to the ground below.
