29 CFR 1926.451(e)(1): When scaffold platforms are more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from another scaffold, structure, personnel hoist, or similar surface shall be used. Crossbraces shall not be used as a means of access. a. On or about February 16, 2017, at the above referenced worksite, employees of Greg Stephens (DBA / Greg Stephens Mason Contractor), were required to work on an elevated platform in the performance of their duties. These employees were observed working from a scaffold platform greater than 2 feet to the next lower level without the proper point of access as outlined in this OSHA standards. The employees were thereby exposed to fall from heights. b. On or about February 16, 2017, employees, including the owner Mr. Stephens, were observed by CSHO using crossbraces as a means of access to a scaffold platform. Abatement documentation is required for this item in accordance with 29 CFR 1903.19(d).

29 CFR 1926.451(f)(3): Scaffolds and scaffold components shall be inspected for visible defects by a competent person before each work shift, and after any occurrence which could affect a scaffold's structural integrity. a. On or about February 16, 2017, at the above referenced worksite, employees of Greg Stephens (DBA / Greg Stephens Mason Contractor), were required to work on an elevated platform in the performance of their duties. These employees were observed mounting scaffolding without prior inspection as outlined in this OSHA standards. The employees were thereby exposed to fall from heights. b. On or about February 16, 2017, employees, including the owner Mr. Stephens, were observed by CSHO using crossbraces as a means of access to a scaffold platform and no employees were observed having inspected the scaffolding from the time of their arrival at the worksite. Abatement documentation is required for this item in accordance with 29 CFR 1903.19(d).
