29 CFR 1926.20(b)(2): Such programs shall provide for frequent and regular inspections of the job sites, materials, and equipment to be made by competent persons designated by the employers:   On or about February 13, 2017, at the above addressed jobsite, safety inspections were made by persons capable of identifying and correcting those hazards which could result in employee injuries. However, corrective action was not taken with regard to scaffolding deficiencies, controlled access zones, and ladder safety.   Abatement documentation is required for this item in accordance with 29 CFR 1903.19(d).

29 CFR 1926.451(h)(2): Where there is a danger of tools, materials, or equipment falling from a scaffold and striking employees below, the following provisions apply:  a. On or about October 31, 2016, employees where engaged in overhand bricklaying activities from an elevated platform / scaffold. The area below this work zone was not barricaded or otherwise demarcated to ensure controlled access into the danger zone. Employees were thereby exposed to struck-by hazards from falling tools, material, and / or debris.  b. On or about October 31, 2016, employees where engaged in overhand bricklaying activities from an elevated platform / scaffold. There were no toe boards installed on the scaffolding planks. Employees were thereby exposed to struck-by hazards from falling tools, material, and / or debris.  Abatement documentation is required for this item in accordance with 29 CFR 1903.19(d).

29 CFR 1926.501(b)(1): "Unprotected sides and edges." Each employee on a walking/working surface (horizontal and vertical surface) with an unprotected side or edge which is 6 feet (1.8 m) or more above a lower level shall be protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems.   a. On or about February 13, 2017, at the above referenced worksite, employees of Xcellent Masonry Inc. were required to work on an elevated platform in the performance of their duties. These employees were observed working from a working surface with a fall potential greater than 6 feet to the next lower level. The working surface was not provided protections as outlined in this standard. The employees were thereby exposed to fall from heights of approximately 17'.   Abatement documentation is required for this item in accordance with 29 CFR 1903.19(d).
