29 CFR 1926.451(e)(1): When scaffold platforms were more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from other scaffold, structure, personnel hoist, or similar surface was not used.  Crossbraces were used as a means of access.  On or about February 8, 2017, employees were installing stone on the commercial building under construction working from a three tiered tubular welded scaffold that did not have a ladder for access, exposing the employees to a fall hazard.

29 CFR 1926.451(f)(3): Scaffolds and scaffold components were not inspected for visible defects by a competent person before each work shift, and after any occurrence which could affect a scaffold's structural integrity:  On or about February 8, 2017, employees were installing stone on the commercial building under construction working from a three tiered tubular welded scaffold that was not inspected before the work shift , exposing the employees to a fall hazard.

29 CFR 1926.451(h)(2)(ii): A toeboard was not erected along the edge of platforms more than 10 feet (3.1 m) above lower levels for a distance sufficient to protect employees below:  On or about February 8, 2017, employees were installing stone on the commercial building under construction working from a three tier tubular welded scaffold that did not have toeboards, exposing the employees below to being struck by tools and materials from the scaffold.

29 CFR 1926.451(g)(4)(i): Guardrail systems were not installed along all open sides and ends of platforms.  On or about February 8, 2017, employees were installing stone on the commercial building under construction working from a three tiered tubular welded scaffold that did not have guardrails on all open sides and ends of platforms, exposing the employees to a fall hazard.  Becerra's Plastering LLC. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.451(g)(1)(vii), which was contained in OSHA inspection number 1063207, citation number 1, item number 1a and was affirmed as a final order on October 15, 2015, with respect to a workplace located at12302 Tierra Este, El Paso, Texas, 79938.
