29 CFR 1926.451(b)(1)(i): Each platform unit (e.g., scaffold plank, fabricated plank, fabricated deck, or fabricated platform) was not installed so that the space between adjacent units and the space between the platform and the uprights was no more than 1 inch (2.5 cm) wide:  a) Jobsite: On February 9, 2017 and at times prior thereto an employee performed stucco work from the top level of a multi-level self -supporting scaffold.  A single 20 inch plank was used, leaving a 10 inch space between the planking and the scaffold uprights.   Note) Certification of corrective action is required for this item.

29 CFR 1926.21(b)(2): The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to the work environment to control or eliminate any hazards or other exposure to illness or injury:  a) Jobsite: On February 9, 2017 and at times prior thereto employees performing stucco activities on a multi level scaffold system did not recognize or acknowledge the hazard of not using base plates and mud sills on each scaffold upright leg to provide a solid foundation for the scaffold.    b) Jobsite: On February 9, 2017 and at times prior thereto employees performing stucco activities on a multi level scaffold system did not recognize or acknowledge the hazard of working on a level that was not fully decked/planked.      c) Jobsite: On February 9, 2017 and at times prior thereto employees performing stucco activities on a multi level scaffold system did not recognize or acknowledge the hazard of climbing on the cross braces for access to the upper level.    d) Jobsite: On February 9, 2017 and at times prior thereto employees performing stucco activities on a multi level scaffold system did not recognize or acknowledge the hazard of working on the top level without a guardrail system in place. 29 CFR 1926.451(e)(1): When scaffold platforms are more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from another scaffold, structure, personnel hoist, or similar surface were not used.  Cross-braces were used as a means of access:  a) Jobsite: On February 9, 2017 and at times prior thereto a safe means of access to the top level of a self-supporting scaffold was not available.  Employees performing stucco activities used the cross-braces for access to the top level of the scaffold.  This exposed the employees to a 13.3 foot fall hazard to the concrete below.  Note) Certification of corrective action is required for this item.

Guardrails or other means of fall protection were not in place. This exposed the employees to a 13.3 foot fall hazard to the concrete below.
