29 CFR 1926.1428(a)(2): The employer's qualified evaluator did not assess the signalman and did not determine that the individual met the Qualification Requirements and did not provide documentation of that determination. An assessment by the employer's qualified evaluator under this option was not portable. Other employers are not permitted to use it to meet the requirements of this section. (a) On or about February 2, 2017, during plate moving operations, a signal person was not evaluated by his employer, prior to starting work.
