29 CFR 1904.39(a)(2): The employer failed to report the in-patient hospitalization of one or more employees or an employee's amputation or an employee's loss of an eye, as a result of a work-related incident, within (24) twenty-four hours:        The employer failed to report an amputation injury with in (24) twenty-four hours as required. On or about January 20, 2017, an employee in the process of adjusting a safety collar around the top of an aerosol can sustained an amputation to the right middle finger when the piston/plunger of the collar placer came down on his finger, crushing it between the top of the can and piston. The amputation was not report until February 02, 2017.

29 CFR 1910.147(c)(4)(i): Procedures shall be developed, documented and utilized for the control of potentially hazardous energy when employees are engaged in the activities covered by this section:             On or about 02/08/2017, written procedures were not developed, documented or utilized for the control of hazardous energies used by employees tasked with clearing jams on the aerosol manufacturing lines. Employees tasked with completing servicing activities (i.e.: clearing jams) were not protected from unexpected start-up of hazardous energy sources such as; but not limited to, electric and pneumatic.

29 CFR 1910.212(a)(3)(ii): Point(s) of operation of machinery were not guarded to prevent employee(s) from having any part of their body in the danger zone(s) during operating cycle(s):         On or about 01/20/2017, guarding for the aerosol line collar placer was inadequate and did not prevent the operator from having any part of their body (hand/fingers) in the danger zone when the machinery cycled. An employee attempting to adjust a safety collar around the top of an aerosol can was severely injured when his hand got caught by the  piston/plunger of the collar placer and crushed was between the top of the can and piston.

On or about February 08, 2017, the employer failed to provide training or information to employees working with hazardous chemicals on the details outline in the new hazard communication standard which encompasses the Global Harmonization System (GHS).
